These Terms and Conditions ("Terms") govern your access to and use of ScrumVote ("Service"), operated by ScrumVote ("we", "our", "us") at scrumvote.com.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 16 years old to use ScrumVote. By registering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@scrumvote.com if you suspect any unauthorised use of your account.

You may not share your account with others, create accounts by automated means, or use the Service for any purpose other than legitimate planning and estimation activities.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorised access to any part of the Service or other users' accounts.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Upload or transmit any malicious code, viruses, or harmful data.
  • Abuse invite links or create sessions for purposes other than legitimate team estimation.

4. Service Availability

We strive to keep ScrumVote available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.

5. Intellectual Property

All content, software, design, and trademarks on ScrumVote are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You retain ownership of any content you create within the Service (such as ticket titles and session data). By using the Service, you grant us a limited licence to store and process that content solely to provide the Service to you.

6. Third-Party Integrations

ScrumVote integrates with third-party services such as Jira (Atlassian). Your use of those integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

7. Data and Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you confirm that you have read and agree to our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of €50 or the amount you have paid to us in the 12 months preceding the claim.

10. Termination

You may delete your account at any time by contacting us at support@scrumvote.com. We reserve the right to suspend or terminate your account immediately if you breach these Terms, without prior notice or liability.

Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the European Union and the member state in which ScrumVote is established, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of the applicable member state.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify registered users by email and update the "last updated" date at the top of this page. Continued use of the Service after such notice constitutes acceptance of the revised Terms.
